Critical Status Acquisition
Defense industry enterprises can obtain critical importance status for the national economy
This status allows reserving military-liable employees for the period of mobilization and martial law - in accordance with the Cabinet of Ministers of Ukraine Resolution No. 76 dated January 27, 2023.
The Ministry of Defense of Ukraine has approved clear criteria by which it determines whether an enterprise meets the requirements for obtaining this status (Order No. 722 dated October 28, 2025).
The decision of the Ministry of Defense working group on compliance is the basis for further employee reservation.

To obtain the status that grants the right to reserve up to 100% of employees, an enterprise must meet one of the following mandatory criteria:
- Executes state contracts or participates in their fulfillment in the defense sector, including under foreign economic agreements. The share of defense-related products must exceed 50% of total production for the most recent reporting period.
- Receives state financial support in the form of grants for the development of innovations and technologies for defense needs (Resolution of the Cabinet of Ministers of Ukraine No. 262, dated March 8, 2024).
- Performs the functions of an authorized entity managing state assets in the defense-industrial complex.
To obtain the status that allows reserving up to 50% of employees an enterprise must meet at least three of the following six criteria:
- Executes state contracts in the defense sector.
- Is involved in fulfilling defense orders, including under foreign economic agreements.
- Is listed in the electronic register of participants and executors of state defense contracts.
- Participates in the implementation of state target programs in the fields of aviation or space activities.
- Implements development programs for the defense-industrial complex, including those related to new technologies or the expansion of production capacities.
- Produces goods, performs works, or provides services used by defense industry enterprises for manufacturing defense-related products.
Important: Enterprises that have already obtained the status of critically important are not required to resubmit documents — the existing decision remains valid.
