Critical Status Acquisition

Defense industry enterprises can obtain critical importance status for the national economy

This status allows reserving military-liable employees for the period of mobilization and martial law - in accordance with the Cabinet of Ministers of Ukraine Resolution No. 76 dated January 27, 2023.

The Ministry of Defense of Ukraine has approved clear criteria by which it determines whether an enterprise meets the requirements for obtaining this status (Order No. 722 dated October 28, 2025).

The decision of the Ministry of Defense working group on compliance is the basis for further employee reservation.

To obtain status with the possibility of reserving up to 100% of employees the enterprise must meet all mandatory requirements:

  • Executes state contracts (or participates in their execution) in the field of defense, including under foreign economic agreements
  • The share of defense products must be more than 50% of the total production volume for the last reporting period
  • Receives state financial support in the form of grants for the development of innovations and technologies for defense needs (CMU Resolution No. 262 dated March 8, 2024)
  • Performs the functions of an authorized subject of management of state assets in the defense-industrial complex.

To obtain status with the possibility of reserving up to 50% of employees the enterprise must meet at least three of six requirements:

  1. Executes state contracts in the field of defense.
  2. Involved in the execution of defense orders (including under foreign economic agreements).
  3. Included in the electronic register of participants in the selection and executors of state contracts.
  4. Participates in the implementation of state target programs in the fields of aircraft construction or space activities.
  5. Implements programs for the development of the defense-industrial complex, in particular regarding new technologies or expansion of production capacities.
  6. Produces goods, performs works or provides services that are used by defense industry enterprises for the production of defense products.

Important: enterprises that have already received critical status do not need to submit documents again - the decision remains valid.
